Holders can change this Terms of Use in order to adapt it to the laws and the market so as the requests that are deemed appropiate by the site's users.
Te use of any services offered by Obture by the user constitutes his acceptance of every Terms of Use at the current version in the moment in which the user signed into it.
Accessing Obture.com
Definition of User:The use of any service provided by Obture.com makes the one using it become an User. Just accessing Obture.com constitutes the use of a service.
To use most of the services provided by Obture.com it would be required signing in.
To sign in, the User shall be in full possession of his physical and mental faculties, be at least 14 years old and, if he or she were under 18 shall be sent by regular mail to the specified address or through digitally signed e-mail to info@obture.com by any parent or guardian with the consent to use Obture.

The User agrees to use Obture, its content and its services as stated in the law, morality, public order and these Terms of Use
The user also agrees to make an appropiate use of the services and/or contents of Obture and to not use them to any illegal activity or which constitute any crime, that violate the rights of others and/or infringes the intellectual and industrial property regulation, as any other applicable legal standards.
The User hereby acknowledges that use of content and/or services offered by Obture is done at his sole risk and responsibility.
Is forbidden for the User if he is under 18 years old to access those sections of Obture which require being over 18 years old.
Not publishing pornographic content.
Not publishing racist content.
Not publishing content which advocates terrorism and anything that threatens the Human Rights
Not transmitting unsolicited or unauthorized advertising, nor any viruses or programs that may damage the computers of the Users or the hardware in which is hosted Obture.
Not using any item which is a trademark or which involves any violation of intellectual and industrial property.
If any of the terms between 3.1 and 3.9 of this Terms of Use document were broken by the User, the user account shall be cancelled without requiring notification by the owners.
Disclaimer
Holders do not guarantee the availability and continuity of Obture. They shall not be liable for the damage caused by the non-continuity or availability of Obture or any of its services.
Holders do not control nor own the contents or any kind of third party information collected at Obture. Therefore they do not guarantee accuracy, veracity and legality of such content.
Holders do not guarantee the absence of elements that may damage or alter the User's computer.
Holders are exempt from any liability for damages of any nature that may cause Obture as well as other Users of the same, being understood that neither the views nor the contents nor any of the data generated by users are responsibility of the Holders.
Holders are exempt from any liability for any damage, regardless of the nature, generated by the access to third party links that are linked from Obture. Also, the User acknowledges and accepts that access to such links will be at his responsibility.
Any contract the user executed with a third party, whether natural or legal person, contacted through the site will be made solely between the User and shuch third person. Accordingly, User acknowledges that the owners have no responsibility for any loss or damage of any kind arising from such contractual relationships made.

As a result of signing in as user in Obture, the User accepts that personal data provided by him or which are provided in the future to Obture, can be processed in a file of personal data. The data recorded may be used to perform statistics, trade promotion, suscription to newsletters, incident management and notifications of significant value for the User so considered by the Holders.
The files created are property and responsibility of Obture. The data holder shall have at all times the right to acces the files and may exercise the rights of rectification, cancelation and opposition in the terms included in the data protection legislation. To this end, should go through digitally signed e-mail to the address info@obture.com or by regular mail to the specified address in this Terms of Use document, indicating the address or e-mail to which transmit the confimation of his activities according to his request.
The data requested in the registration are all compulsory. Obture would not give such information to third partiess unless it is strictly necessary for the operation of any of the services provided.
Holders communicate to the User that accessing the server or servers where Obture is hosted would be recorded. In adition to that, the pages he visits belonging to Obture.com network will be recorded too. This data will be stored in a file that will be processed by Obture so for the purpose of determining the number of pageviews as for the realization of statistics in order to improve the service provided.
To provide faster service and speedy clearance of access, Obture uses "cookies". A "cookies" is a piece of information storesd on the visitor's hard drive through his browser. This information can be later retreived by the server on subsequent visits because of containing data necesary to access the service. The "cookies" are generally associated with an anonymus user, not allowing to acces to personal data or, in general, to data on the user's hard drive. If the user configures to reject cookies this speed of service an its quality may decrease.
User generated content
The Intellectual Property Act of the Government of Spain sets the origyn of the copyright in the very moment in which content is generated. According to this, only the User can take decisions related to distribution and selling of such contents.
The user gives the photographs submitted to Obture to their exposure on that site. Such transfer does not limit the copyright in the photograph, being all and every of those rights property of the User
If the User detects his copyright has been violated must contact through regular mail to the specified address in this document or through e-mail to info@obture.com in order to investigate as quickly as possible such incidence.
