Intellectual property over your pictures
Lets make something clear...
- When you upload a picture to Obture you keep the copyright over it
- If you want to change some rights related to distribution and selling of it it would be enough to apply any of the Creative Commons licenses from the Photo Edition page.
If you want to learn more about Creative Commons licensing and copyright you must continue reading.
Intellectual property
In Spain, copyright is protected by the Ley de Propiedad Intelectual (LPI). To check how is it regulated at your own country you can check it here
That Act defines the author as the person which creates a piece, no matter if he does or not a commercial use of it. Thus, no one can claim the authorship of a piece you have created.
This has to be clear:
Pictures you have taken and shared at Obture are yours, thus copyright belongs to you. No way Obture gets any property over the pictures. It will not use them to any end either commercial or not without asking for your permission through e-mail, regular mail or phone.
LPI sets the appearing of copyright in the very same moment in which the picture is taken. Thus only you can take decissions about distribution or commercial uses of your piece. In order to do that we offer you a variety of Creative Commons licenses which allow you to control the use which third parties can do of your picture.
Creative Commons Licenses
Attribution (by):
Any use of the piece is allowed, including commercial uses, so as the creation of derivated pieces, the distribution of which is also allowed with no restrictions.
Attribution - Non-Commercial (by-nc):
It is allowed the creation of derivative work if it is not used for commerrcial purposes. Neither the original piece can be used with commercial purposes.
Attribution - Non-commercial - Share Alike (by-nc-sa):
It is not allowed any commercial use of the original piece neither of the possible derivative work, the distribution of those items must be done with the same license which regulates the original piece.
Attribution - Non-Commercial - No Derivatives (by-nc-nd):
It is not allowed any commercial use of the original nor the creation of derivative work.
Attribution - Share Alike (by-sa):
It is allowed the commercial use so of the original piece as of the possible derivatives, the distribution of which must be done with the same license applied to the original.
Attribution - No Derivatives (by-nd):
It is allowed the commercial use of a piece but not the creation of derivatives.
Applying a Creative Commons license does not mean you are losing author's royalties. This kind of licenses offer some rights to third parties under certain conditions to its distribution and selling.
